Welcome to Skip Bin Marketplace Australia (“we,” “us,” “our,” or “Skip Bin Marketplace”). These Terms of Service (“Terms”) govern your access to and use of the website located at au.skipbinmarketplace.com and any related mobile application or services we offer (collectively, the “Platform”). By accessing or using our Platform, you agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated by reference. If you do not agree with these Terms, you must not use the Platform.


1. Acceptance of Terms

By accessing, browsing, or using this Platform, including registering for an account or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and any additional guidelines or policies referenced herein. You also represent that you are of legal age to enter into a binding agreement under the laws of Australia.

2. Purpose of Skip Bin Marketplace

Skip Bin Marketplace is an online marketplace that connects individuals or businesses seeking skip bin services (“Seekers”) with independent skip bin providers (“Suppliers”). We provide a platform through which Suppliers can list skip bins with specified rates, and Seekers can book these services for short-term use. Our Platform adds a 10% service fee (uplift) on top of the Supplier’s base rate, which is payable by the Seeker at checkout (collectively, “Services”).

Skip Bin Marketplace is not the provider of the skip bins or the related services; it merely facilitates the transaction between Seekers and Suppliers.

3. Registration and Account

  • Account Creation: To access certain features of the Platform, you must create an account and provide accurate and complete registration information.
  • Account Responsibility: You are responsible for maintaining the confidentiality of your login credentials. You agree to promptly notify us of any unauthorised access or use of your account.
  • Eligibility: You must be at least 18 years of age and capable of forming a legally binding contract to use the Platform.

4. Supplier Obligations

  • Accurate Listings: Suppliers must provide accurate and comprehensive information regarding skip bin size, capacity, allowed waste types, rates, and any additional charges that may apply.
  • Compliance with Laws: Suppliers must comply with all relevant Australian laws, regulations, and local council requirements when offering skip bin services.
  • Payment Structure: Skip Bin Marketplace adds a 10% service fee to Supplier-listed rates. Suppliers agree that this fee is retained by Skip Bin Marketplace as compensation for hosting and managing the Platform.
  • Acceptance or Decline of Bookings: Suppliers will receive booking requests via email or the Platform. If a Supplier fails to confirm or decline a booking within the specified timeframe (typically 72 hours), the booking may be automatically cancelled or expire.
  • Indemnity for Accuracy and Service Quality: Suppliers agree to defend and indemnify Skip Bin Marketplace for any claims arising from inaccuracies in their listings or from the provision (or non-provision) of their skip bin services to Seekers.

5. Seeker Obligations

  • Review Listings Carefully: Seekers are solely responsible for reviewing and understanding each Supplier’s listing, including but not limited to bin dimensions, capacity, allowed waste types, pricing, and applicable terms.
  • Payment Responsibilities: At checkout, Seekers will pay a service fee (retained by Skip Bin Marketplace) plus any applicable charges. The remaining balance of the skip bin service is payable directly to the Supplier, as outlined in the booking summary and automated confirmation emails.
  • No Unwarranted Chargebacks: If there is a dispute with a Supplier regarding the provision or quality of the skip bin service, the Seeker agrees to first contact Skip Bin Marketplace to resolve the matter before initiating a chargeback or other refund mechanisms. Chargebacks initiated without allowing Skip Bin Marketplace an opportunity to investigate may result in suspension or termination of the Seeker’s account.
  • Compliance with Waste Disposal Regulations: Seekers agree to follow all relevant Australian laws and regulations for waste disposal and to avoid placing prohibited items or hazardous materials in the skip bin unless explicitly permitted by the Supplier.

6. Payment and Fees

  • Service Fee: Skip Bin Marketplace charges Seekers a 10% service fee on top of the base rate set by Suppliers. This fee is non-refundable once a booking is confirmed, except as required by law or as otherwise stated in these Terms.
  • Payment Processing: Payments are processed securely via third-party payment providers (e.g., PayPal). Skip Bin Marketplace does not store any credit card details.
  • Refunds: If a Supplier declines or cannot fulfill a booking, Skip Bin Marketplace will refund the Seeker any service fees charged. In all other cases, refunds are at the discretion of Skip Bin Marketplace, except where required by the Australian Consumer Law.

7. Role of Skip Bin Marketplace; Disclaimer of Liability

  • No Warranty on Supplier Services: Skip Bin Marketplace acts solely as an intermediary platform. We do not own, control, or provide skip bins; therefore, we make no warranties or representations about the reliability, quality, or suitability of any Suppliers’ services.
  • Limitation of Liability: To the fullest extent permitted by Australian law, Skip Bin Marketplace and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, personal injury, or property damage, arising out of or relating to your use of (or inability to use) the Platform.
  • Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any rights or remedies that you may have under the Australian Consumer Law or other applicable legislation which cannot be excluded, restricted, or modified by agreement.

8. Indemnification

You agree to indemnify, defend, and hold harmless Skip Bin Marketplace, its affiliates, directors, employees, agents, and Suppliers from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to legal fees) arising out of or in connection with:

  • Your violation of these Terms;
  • Your use or misuse of the Platform;
  • Your dispute with any Supplier or Seeker, including any personal injury or property damage claims related to the provision (or non-provision) of skip bin services;
  • Your violation of any law, rule, or regulation in Australia or any other applicable jurisdiction.

9. Intellectual Property Rights

All content on the Platform, including text, graphics, logos, icons, images, and software, is the property of Skip Bin Marketplace or its licensors and is protected by Australian and international copyright laws. You may not copy, modify, reproduce, republish, distribute, transmit, display, or sell any material from the Platform without our prior written consent.

10. Termination

  • Termination by Skip Bin Marketplace: We may suspend or terminate your account at any time, with or without notice, for any reason including violation of these Terms.
  • Termination by User: You may delete your account at any time by following the instructions on the Platform or contacting us at the email address provided below. However, any ongoing obligations under these Terms shall survive account deletion.

11. Dispute Resolution

If any dispute arises between you and Skip Bin Marketplace in connection with these Terms, the parties agree to first attempt to resolve the dispute informally and in good faith. If the dispute cannot be resolved informally, it shall be referred to mediation or arbitration in accordance with the laws of Australia, or as otherwise agreed by the parties in writing.

12. Governing Law

These Terms and any action related thereto shall be governed by and construed in accordance with the laws of Australia without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of Australia.

13. Changes to the Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 14 days’ notice prior to any new terms taking effect. By continuing to access or use the Platform after those revisions become effective, you agree to be bound by the revised Terms.
